The Maiduguri Zonal Command of the Economic and Financial Crimes Commission, EFCC, on Tuesday, January 17, 2023, secured the conviction and sentencing of one Iliyas Abba Suleiman before Justice Umaru Fadawu of the Borno State High Court, Maiduguri to a year imprisonment for cheating.
The defendant’s journey to the correctional facility started when the petitioner, Bagana Dunoma alleged that the defendant deceived him to deliver the sum of N700, 000.00 for the supply of food items for distribution at Al-ansar Secondary School, Maiduguri, Borno State.
The one count reads: “That you Iliyas Abbas Suleiman, sometime in March, 2022 at Maiduguri within the jurisdiction of this Honourable Court, did honestly induced Kasim Ibrahim to obtain the sum of N 700,000.00 under the guise of executing a contract of food distribution to Al-Ansar Secondary School Maiduguri, Borno State which you are yet to pay the said sum and thereby committed an offence contrary to section 320 (a) and punishable under section 322 of the Penal Code Cap 102 Laws of Borno State.”
The defendant pleaded not guilty to the charge preferred against him by the EFCC, hence his full trial. In the course of the trial, counsel for the prosecution, Mukhtar Ali Ahmed presented two witnesses and tendered several documents as exhibits.
Ayenshola Adeife A. who held the brief for the prosecution counsel, said the prosecution had proved its case beyond reasonable doubt and prayed the court to convict and sentence the defendant as charged. He further informed the court that the nominal complainant has been fully restituted.
Justice Fadawu convicted the defendant and sentenced him to one year imprisonment with an option of N100, 000.00 (One Hundred Thousand Naira) fine.
