Justice Mojisola Dada of the Special Offences Court sitting in Ikeja Lagos, on Thursday, October 3, 2022, granted bail to one Adeleke Fayose, who is being prosecuted for an alleged N66.5m oil fraud, in the sum of N50m.
Fayose was arraigned alongside his company, Brooks and Knight International Limited, on October 27, 2022 by the Lagos Zonal Command of the EFCC on a three-count charge bordering on obtaining money under false pretences and stealing to the tune of N66.5 million.
One of the counts reads: "Adeleke Fayose and Brooks & Knight International Limited, on or about the 9th August 2018 at Lagos, within the jurisdiction of this Honourable Court, dishonestly stole the sum of N40, 000,000.00 (Forty Million Naira) property of GOSL Nigeria Limited."
Another count reads: "Adeleke Fayose and Brooks & Knight International Limited, on or about the 10th August 2018 at Lagos, within the jurisdiction of this Honourable Court, dishonestly stole the sum of N26,459,200.00 (Twenty-Six Million Four-Hundred and Fifty-Nine Thousand Two Hundred Naira) property of GOSL Nigeria Limited."
He pleaded "not guilty" to the charges.
At today’s proceedings, the defence counsel, Chineye Udeh, moved the bail application of the defendant.
In moving the application, Udeh urged the court to grant the defendant bail on liberal terms, arguing that the defendant, who had also been granted administrative bail by the EFCC, never jumped bail.
"The defendant will not jump bail, and we pray the court to grant bail with liberal conditions," Udeh said.
The prosecuting counsel, S.O. Daji, while moving the counter-affidavit of the prosecution, opposed the application for bail by the defence.
After listening to both parties, Justice Dada granted bail to the defendant in the sum of N50 million, with two sureties in like sum.
The sureties must be resident within jurisdiction and must show evidence of tax payment in the past three years.
They are also to have a lien placed on their bank accounts.
The defendant was also ordered to submit his passport to the custody of the court.
The case has been adjourned till December 19, 2022 for trial.
