Justice Adenike Akinpelu of the Kwara State High Court sitting in Ilorin has sentenced one Adetunji John Adebayo from Igbeti, Olorunsogo Local Government Area of Oyo State, to six months imprisonment for offences bordering on attempted cheating by personation.
The offence is contrary to Section 95 punishable under Section 324 of the Penal Code Law.
Adetunji, 20, pleaded guilty to the one count charge preferred against him by the Ilorin Zonal Command of the Economic and Financial Crimes Commission, EFCC.
Following his plea, counsel to the EFCC, R. A Alao, urged the court to hold that “the prosecution has established a prima-facie case against the defendant considering his plea, extra-judicial statements and exhibits tendered”.
Justice Akinpelu, in her judgment on Thursday, October 7, 2021 said that the court had carefully considered the case particularly the plea of guilt entered by the defendant and all the exhibits tendered. She held that the prosecution had proved its case beyond reasonable doubt.
Her words: “The defendant confessed to the crime in his extra-judicial statements which he made to the EFCC. In law, no evidence is stronger than the extra-judicial statement of a defendant. In the light of the foregoing, I hold that, the prosecution has proved its case beyond reasonable doubt”.
Adetunji was thereafter, sentenced to a term of six months imprisonment with option of fine of N300,000 (Three Hundred Thousand Naira Only).
