MAN SENTENCED TO 4 YEARS IMPRISONMENT FOR N1.39m FRAUD

The Economic and Financial Crimes Commission, EFCC Gombe Zonal office today secured the conviction of one Mahmud Mo'Allahyidi before Justice Nathan Musa  of Adamawa state High Court on two count charge bordering on Criminal Breach of Trust and Cheating. ‎


The convict was arrested  following a petition by one Ghazali Mai-shanu Ali alleging that sometime in April, 2017, he met the convict and strucked a deal to buy grains from him. He bought the grains and paid the transportation for delivery to Kano. It was the last he heard from the convict who not only failed to deliver the consignment but cut all communication with the complainant.

After the investigation was concluded he was arraigned today before the court.

Count one of the charge reads, ”that you, Mahmud Mo'Allahyidi of No. 79 Abuja Road, Yola South Local Government, Adamawa State, within the jurisdiction of this Honourable Court, sometime in April 2017, while entrusted with the domination over property, 80 bags of Guinea Corn and 6 bags of Groundnut respectively valued at One Million Three Hundred and Ninety Thousand Naira  (#1, 390, 000.00) belonging to Ghazali Mai-shanu Ali dishonestly converted same to your personal use and thereby committed an offence contrary to Section 311 and Punishable under Section 312 of the Penal Code“.

When the charge was read to him, he pleaded guilty. The prosecution counsel S.M Aliyu consequently applied under Section 157 of the CPC that the accused person be tried summarily and also for a review of the facts of the case.

Justice Nathan convicted and sentenced the accused  to three years imprisonment with the option of N50,000 fine for count one  (criminal breach of trust) , and one year imprisonment and option of N30,000 fine on count two (Cheating).

However, the convict was ordered to pay restitution to the complainant to the tune of the amount involved through EFCC Gombe Zonal office.
