A three-man panel of the Court of Appeal, Lagos Division, on Friday, January 26, 2018 upheld the conviction and sentencing of one Friday David, who was charged on one-count of stealing to the N72,077,082.
David was convicted and sentenced by Justice M.O. Obadina of the High Court of Lagos State sitting in Lagos to two years imprisonment for stealing.
During the trial, the prosecution counsel called eleven witnesses and tendered 38 exhibits marked P1-P38.
The defence also tendered three exhibits marked D1, D2 and D3.
However, exhibit D3 tendered by the defence was rejected by the court.
In a judgement delivered on December 21, 2016, Justice Obadina convicted the appellant and sentenced him to two years imprisonment for stealing the money, which is the property of Universal Steels Limited.
The judge also ordered the convict to make restitution to the complainant.
Dissatisfied by the judgement, David approached the Court of Appeal urging it to set aside the judgement.
But in a unanimous decision delivered by Justice Ogakwu Okechukwu today, the appellate court held that the appeal lacked in merit and accordingly affirmed the judgment of the trial court.
