The Economic and Financial Crimes Commission, EFCC, on Tuesday 4th April, 2017, arraigned one Michael Faluyi before Justice P. I. Ajoku of the Federal High Court, sitting in Benin- City, Edo State on a 2-count charge bordering on obtaining money by false presence.
Count one of the charge reads: “that you Michael Faluyi doing business in the name and style of Hepzibal Faloye Oil and Gas Ventures on or about the 10th day of August, 2013 at Benin- City within the Jurisdiction of Federal High Court, with intent to defraud, induced Omorogbe Albert Igbinoba and Anygbeso Bright to supply 33,000 litres of Kerosene to yourself under the false pretences that the kerosene would be paid for, a pretext which you knew to be false and thereby committed an offence contrary to Section 1(2) of the Advance Fee Fraud and Other Related Offences Act 2006 and punishable under Section 1(3) of the same Act”.
Count two of the charge reads,” that you Michael Faluyi doing business in the name and style of Hepzibal Faloye Oil and Gas Ventures on or about the 18th day of June, 2013 at Benin- City within the Jurisdiction of Federal High Court, with intent to defraud, induced Omorogbe Albert Igbinoba and Anygbeso Bright to supply 32,000 litres of AGO to yourself under the false pretences that the said AGO would be paid for, a pretext which you knew to be false and thereby committed an offence contrary to Section 1(2) of the Advance Fee Fraud and Other Related Offences Act 2006 and punishable under Section 1(3) of the same Act”.
He pleaded not guilty to the charge when it was read to him.
In view of his plea, the prosecution counsel, Sadiq Hussaini, asked the court to fix a date for the commencement of trial and that the accused person be remanded in prison custody. However, counsel to the defendant, S. O. Omereye made an oral application for bail which was refused by the court. He was asked to make a formal application for bail.
Justice Ajoku adjourned the case to June 1, 2017 for trial and ordered that the accused be remanded in prison custody
