Justice Abubakar Mahmud Talba of the High Court of the Federal Capital Territory, Abuja on Monday, February 2, 2015 granted bail to Daniels Nat who is standing trial alongside Dennis Edimoh and Peter Oko Amadi on a four-count charge bordering on criminal breach of trust, forgery and conspiracy.
The accused are being prosecuted by the Economic and Financial Crimes Commission, EFCC, for alleged forgery of a Federal Government Certificate of Occupancy to plot No 42, Block XIII, Federal Government Layout, Gwarimpa District, Abuja, which was duly allotted to one Mr. Adekoya Daniel Oladepo.
The trio used the forged certificate as collateral to solicit investment from Ambifel Services Limited, whom they swindled to the tune of N7million having promised 30 percent return on investment after a maturity period of 60 days. Since the release of the fund, they went underground.
Daniel, Edimoh and Amadi were arraigned on February 9, 2015 and pleaded not guilty to all the charges.
While the court admitted Edimoh and Amadi to bail, Daniel’s attempt to secure bail orally through his counsel, N. U Akpan was refused upon an objection raised by counsel to EFCC, Faruk Abdallah, that the accused had earlier failed to honour the bail terms earlier granted him by the Commission.
Moving the bail application at a resumed hearing of the case March 2, Akpan argued that bail is a constitutional right of the accused though at the discretion of the court. He urged the court to exercise discretion in favour of the accused and admit him to bail.
Justice Talba admitted the accused to bail in the sum of N2m (two million naira) with two sureties in like sum.
The case has been adjourned to March 30, 2015 for continuation of trial.
